U.S. Supreme Court Overturns PASPA: How The NFL, NBA, MLB, Others Have Reacted

By Barry Janoff

May 14, 2018: The Supreme Court today opened the door for legalized sports betting across the U.S. on a state-by-state basis, deciding in a 6-3 ruling to overturn the Professional and Amateur Sports Protection Act, which passed in 1992 and, in effect, required most U.S. states to ban gambling on the outcome of sports events.

Justices Ruth Bader Ginsburg, Stephen Breyer and Sonia Sotomayor dissented.

The American Gaming Assn. estimates that people in the U.S. illegally wager some $150 billion on sports each year.

The full 49-page report can be accessed at the U.S. Supreme Court Web site.

Justice Samuel Alito wrote for the court, "The legalization of sports gambling requires an important policy choice, but the choice is not ours to make. Congress can regulate sports gambling directly, but if it elects not to do so, each state is free to act on its own. Our job is to interpret the law Congress has enacted and decide whether it is consistent with the Constitution. PASPA is not."

Nevada, Montana, Oregon and Delaware were not part of the 1992 decision, having previously approved to varying degrees sports wagering before PASPA took effect.

New Jersey challenged the PASPA ruling, led by then-Gov. Chris Christie, who today wrote on his Twitter account, “A great day for the rights of states and their people to make their own decisions. New Jersey citizens wanted sports gambling and the federal Gov't had no right to tell them no. The Supreme Court agrees with us today. I am proud to have fought for the rights of the people of NJ.”

Pro sports in the U.S. have also reacted to the decision.

NBA commissioner Adam Silver: “Today’s decision by the Supreme Court opens the door for states to pass laws legalizing sports betting.

"We remain in favor of a federal framework that would provide a uniform approach to sports gambling in states that choose to permit it, but we will remain active in ongoing discussions with state legislatures. Regardless of the particulars of any future sports betting law, the integrity of our game remains our highest priority.”

NFL: "The NFL's long-standing and unwavering commitment to protecting the integrity of our game remains absolute.

”Congress has long-recognized the potential harms posed by sports betting to the integrity of sporting contests and the public confidence in these events. Given that history, we intend to call on Congress again, this time to enact a core regulatory framework for legalized sports betting. We also will work closely with our clubs to ensure that any state efforts that move forward in the meantime protect our fans and the integrity of our game."

NFLPA: "The Supreme Court's decision today reaffirms our decision to collaborate with the other sports unions on the issues of player safety, integrity of our games and privacy and publicity rights,.

“Our union will monitor developments closely and address the implications of this decision with the NFL, state legislators and other relevant stakeholders."

"Regardless of the particulars of any future sports betting law, the integrity of our game remains our highest priority.”

MLB: "Today's decision by the United States Supreme Court will have profound effects on Major League Baseball. As each state considers whether to allow sports betting, we will continue to seek the proper protections for our sport, in partnership with other professional sports.

“Our most important priority is protecting the integrity of our games. We will continue to support legislation that creates air-tight coordination and partnerships between the state, the casino operators and the governing bodies in sports toward that goal."

NHL: "The Supreme Court's decision today paves the way to an entirely different landscape — one in which we have not previously operated. We will review our current practices and policies and decide whether adjustments are needed, and if so, what those adjustments will look like.

“It's important to emphasize that the Supreme Court's decision has no immediate impact on existing League rules relating to sports wagering, and particularly, wagering involving NHL games. So, while changes may be considered in the future, today's decision does not directly impact the operation of the league or any of our clubs in the short term."

American Gaming Assn.: "Today's decision is a victory for the millions of Americans who seek to bet on sports in a safe and regulated manner. According to a Washington Post survey, a solid 55 percent of Americans believe it's time to end the federal ban on sports betting. Today's ruling makes it possible for states and sovereign tribal nations to give Americans what they want: an open, transparent, and responsible market for sports betting.

"Through smart, efficient regulation this new market will protect consumers, preserve the integrity of the games we love, empower law enforcement to fight illegal gambling, and generate new revenue for states, sporting bodies, broadcasters and many others.

"The AGA stands ready to work with all stakeholders — states, tribes, sports leagues, and law enforcement – to create a new regulatory environment that capitalizes on this opportunity to engage fans and boost local economies."

Fantasy Sports Trade Assn.:
"Today’s Supreme Court decision to overturn PASPA is expected to have a significant impact on the fantasy sports industry and the member companies of the Fantasy Sports Trade Association.

"We expect that many fantasy sports companies will elect to offer sports gambling products in addition to their fantasy sports games and the FSTA intends to support those member companies.

"We are excited about the variety of gameplay innovations that will be developed in the future. Consumers will benefit from a new era of fantasy games that merge fantasy sports and sports betting.

"To date, 19 states have formally legalized fantasy sports and the FSTA expects that trend to continue as states begin legalizing sports betting.

"We emphasize that fantasy sports are games of skill and we continue to stress the distinctions between fantasy sports and sports betting.

"The biggest potential downside to the legalization of sports betting is the prospect of heightened, costly regulation. If fantasy sports operators are lumped together with sports gambling companies, fantasy sports companies may be required to meet the regulatory standards of gambling companies.

"With this in mind, we will continue to work for common sense legislation, fee structures that allow all operators to remain viable and clarification that fantasy sports contests are legal games of skill."
